1. Acceptance of Terms

By accessing and using Mythivara ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Use License

When you purchase a story (audiobook or video book) from Mythivara, you are granted a personal, non-exclusive, non-transferable license to:

• Download and store the content on your personal devices
• Stream or play the content for personal, non-commercial use
• Access the content unlimited times

You may NOT:

• Redistribute, sell, rent, or lease the content
• Modify, reverse engineer, or create derivative works
• Use the content for commercial purposes unless explicitly permitted
• Remove copyright, watermark, or proprietary notices
• Share your account credentials with others
• Copy or clone the app, its structure, branding, or content catalog

3. Content Creation

All stories on Mythivara are created using advanced technology. While we strive for quality and appropriateness, content may occasionally contain unexpected elements. We review content before publication, but cannot guarantee perfection in every instance.

4. Purchases and Payments

By making a purchase on Mythivara, you agree to:

• Provide accurate and complete payment information
• Pay all charges at the prices in effect at the time of purchase
• Be responsible for all charges incurred under your account
• Pay applicable taxes, if any

We use third-party payment processors (Stripe) to process payments. By making a purchase, you agree to their terms as well.

Prices are subject to change without notice, but price changes will not affect purchases already made.

5. Refund Policy

Due to the digital nature of our products and immediate access upon purchase, all sales are final. However, we will consider refund requests on a case-by-case basis under the following circumstances:

• Technical Issues: Inability to access purchased content due to technical errors on our end
• Duplicate Charges: Accidental duplicate purchases made within a short time frame
• Misrepresentation: Content that significantly differs from its description or preview
• Processing Errors: Payment errors that resulted in incorrect charges

Refund Conditions:

• Refund requests must be submitted within 48 hours of purchase
• You must provide a detailed explanation for the refund request
• Content must not have been substantially consumed (e.g., read/listened to more than 25%)
• Account must be in good standing with no history of abuse

Refunds, if approved, will be processed within 5-10 business days to the original payment method. Upon refund, access to the purchased content will be revoked. To request a refund, contact our Support Team.

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

7. Age Restrictions and Adult Content

Our content is categorized by age group:

• Children (Ages 1-10): Content appropriate for young children
• Teens (Ages 11-17): Content appropriate for teenagers
• Adults (Ages 18+): Content appropriate for mature audiences

Adult-Only Content: Some content is restricted to users 18 years and older. This includes stories with mature themes, sexual content, graphic violence, or explicit language. To access adult-only content, you must:

• Be at least 18 years of age
• Verify your age through our age verification system
• Accept that you understand the mature nature of the content

By verifying your age, you confirm under penalty of perjury that you are at least 18 years old. Falsifying your age to access adult content is a violation of these Terms and may result in immediate account termination.

Parents and guardians are responsible for monitoring their children's use of the Service and ensuring they access age-appropriate content. We recommend using parental controls and supervising minors' access.

8. Intellectual Property

All content on Mythivara, including but not limited to text, graphics, logos, audio, video, software, layouts, designs, branding, compilations, quote cards, story assets, and generated media, is the exclusive property of Mythivara or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. All rights are reserved unless expressly granted in writing.

You may not copy, clone, scrape, reproduce, republish, mirror, frame, white-label, resell, extract, train on, or create competing products or services from any part of the Service, its content library, its visual systems, or its underlying creative presentation without prior written permission from Mythivara.

If you purchase content from Mythivara, that purchased item is yours for your personal use and enjoyment, subject to these Terms. Your purchase gives you the right to keep, access, use, and enjoy the purchased content for yourself, but does not transfer ownership of Mythivara's platform, brand, catalog, software, or any unpurchased content.

9. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Attempt to bypass security measures or access restrictions
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Collect or store personal data about other users

10. Service Modifications and Termination

We reserve the right to modify or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. No advice or information obtained from us shall create any warranty not expressly stated in these Terms.

12. Limitation of Liability

Mythivara shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you for the specific content in question.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mythivara, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mythivara operates, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with commercial arbitration rules, except where prohibited by law. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Mythivara concerning the Service.

17. Changes to Terms

We reserve the right to update these Terms of Service at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
